Eligibility

Who qualifies for gratuity?

Full-time expat employees after one continuous year of service.
Resignation and termination are treated equally under the 2021 law.
Part-time workers, pro-rated by their contracted hours.
UAE & GCC nationals (they receive a pension instead).
Anyone with less than one continuous year of service.

Federal Decree-Law 33 / 2021

  • Based on basic salary only — allowances excluded.
  • 21 days of basic wage per year for the first 5 years.
  • 30 days of basic wage for each year beyond 5 years.
  • Total capped at 2 years’ overall pay.
  • The old resignation reduction (1980 law) has been abolished.

Gratuity uses the basic salary, never the gross total.

Unpaid leave days are deducted from the service period.

Questions employees ask

How is UAE gratuity calculated?
On your last basic salary: 21 days per year for the first 5 years and 30 days for each additional year, prorated for partial years, capped at two years of pay.
Is gratuity based on basic or gross salary?
On the basic salary only. Housing, transport and other allowances are excluded.
Does resigning reduce my gratuity?
No. Decree-Law 33/2021 abolished the old resignation reduction. With at least one continuous year of service, resignation and termination are treated the same.
Do DIFC and ADGM employees get gratuity?
DIFC operates the DEWS savings scheme instead of a traditional gratuity, so figures can differ from this estimate.
